These Terms and Conditions ("Terms") are a binding agreement between you and ACKBiz ("we", "us", "our") that govern your download, installation, and use of the GPS Map Camera app ("the App", "GPS Map Camera") on Android (com.ackbiz.gps_camera) and iOS (com.ackbiz.gps-camera). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. If you are using the App on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf. You must be at least 16 years old, or the age of digital majority in your country, to use the App.
GPS Map Camera is a camera that takes photos and stamps them with information such as the date and time, GPS coordinates, an address, a map, weather, altitude, and compass, and plots your photos on a map so you can see where they were taken. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited licence to install and use the App on devices you own or control, for your own personal or internal business use. All rights not expressly granted are reserved by us and our licensors. Except as permitted by law, you may not copy, modify, translate, or create derivative works of the App; reverse-engineer, decompile, or disassemble it or attempt to extract its source code; rent, lease, lend, sell, sublicense, or distribute it; remove or alter any proprietary notices; or use the App in any way that breaches these Terms or applicable law.
Subscriptions, billing, and the free tier
The App offers a free tier that is supported by advertising, and by using the free tier you agree that ads may be shown. Pro is an optional paid subscription that unlocks additional features and removes ads, and its title, price, billing period, and features are shown in the App at the point of purchase. Subscriptions renew automatically: unless you cancel at least 24 hours before the end of the current period, your subscription will renew and your payment method will be charged the then-current price for the next period through the app store, and your subscription continues until you cancel.
All purchases are processed by the Apple App Store or Google Play, and entitlements are managed through RevenueCat, with payment charged to your app-store account. You manage and cancel subscriptions in your app-store account settings — on Apple in Settings under your name and then Subscriptions, and on Google Play in the Play Store under Subscriptions — and not by deleting the App. You may cancel at any time; cancellation stops future renewals and you keep Pro until the end of the paid period, and uninstalling the App does not cancel a subscription. Except where required by law, payments are non-refundable and partial periods are not refunded, and any refunds are handled solely under the policies of the Apple App Store or Google Play, so please request them through the relevant store. We may change subscription prices and features, and where required we will notify you and obtain your consent before a price change takes effect; otherwise changes apply from your next renewal. If a free trial or promotional offer is provided, any unused portion is forfeited when you buy the related subscription, and the subscription auto-renews at the standard price when the trial ends unless you cancel beforehand.
Acceptable use
You agree not to use the App to break any law or regulation or to infringe anyone's rights; to photograph, record, or track people, private property, or restricted or secure locations where you do not have the right or consent to do so; to harass, stalk, surveil, threaten, or invade the privacy of any person; to create false, forged, or misleading records, or to tamper with stamps to misrepresent when or where a photo was taken; to interfere with, disrupt, or attempt to gain unauthorised access to the App, its providers, or their systems; or to use the App for any unlawful, fraudulent, harmful, or deceptive purpose. You are solely responsible for how you use the App and for complying with all laws that apply to your photography and recording, including privacy, data-protection, trespass, wiretapping and recording-consent, and drone and aviation laws.
Your content
Your photos and recordings are yours, and we do not claim ownership of the content you capture. As explained in our Privacy Policy, your photos and their capture details are stored locally on your device, and we do not upload or store copies. You are solely responsible for the content you capture, keep, export, and share, and for ensuring you have any consents and rights required to photograph or record other people, property, or locations, and you agree to respect the privacy and legal rights of others. If you share content through the App to third-party platforms, that sharing is governed by those platforms' own terms.
Accuracy disclaimer
The App's location, address, map, weather, timezone, and other stamped information are provided for general and informational purposes only and may be inaccurate, incomplete, delayed, or wrong. GPS and location data depend on your device, on satellite and signal conditions, and on third-party services, and can be off by a wide margin or unavailable; addresses come from third-party reverse-geocoding and may be approximate or incorrect; weather is fetched from a third-party service and may be outdated or wrong; timezone and time depend on device and library data and may be incorrect; and maps and tiles are provided by third parties and may be out of date. You must not rely on the App as your sole or authoritative source for any legal, safety, navigation, surveying, engineering, insurance, evidentiary, law-enforcement, emergency, or life-critical purpose, and you must not use the App for navigation while driving or in any situation where inaccurate location or timing could cause injury, loss, or legal consequences. Always verify critical information with an authoritative, independent source, and you assume all risk arising from reliance on stamped information.
Intellectual property
The App, including its software, design, branding, names, and logos, and all related intellectual property, is owned by us and our licensors and is protected by law, and these Terms do not transfer any ownership to you. Third-party content such as map tiles and data is owned by its respective owners and used under their licences, including OpenStreetMap contributors' data under the Open Database License, and you agree to comply with those attributions and licences where they apply.
Third-party services
The App uses third-party services, including Google AdMob, Google and Firebase, Google Maps Platform, Apple, RevenueCat, OpenStreetMap, reverse-geocoding providers, and Open-Meteo. Your use of those services may be subject to their own terms and privacy policies, which are listed in our Privacy Policy. We do not control and are not responsible for third-party services, their availability, or their content, and we disclaim liability for them to the extent permitted by law.
Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, accurate, or available, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Limitation of liability
To the maximum extent permitted by law, in no event will ACKBiz, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, or for damages arising from your reliance on stamped location, address, weather, or time information, arising out of or relating to the App or these Terms, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim or fifty US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
Indemnity
You agree to indemnify, defend, and hold harmless ACKBiz, its affiliates, and their officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use or misuse of the App, the content you capture, keep, export, or share, your violation of these Terms or any law, or your infringement of any third party's rights, including privacy rights.
Termination
These Terms apply until terminated, and your licence ends automatically if you breach them. We may suspend or terminate your access to the App or parts of it at any time, with or without notice, including if required by law or an app store, or to protect the App or others. On termination you must stop using the App and delete it, and the sections that by their nature should survive termination will continue to apply.
Governing law
These Terms are governed by the laws of Gujarat, India, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights you have in your country of residence, you agree that the courts located in Gujarat, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App. Nothing in this section deprives you of the protection of the mandatory laws of your place of residence.
Apple App Store terms
If you obtained the App from the Apple App Store, the following also applies. These Terms are between you and ACKBiz only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal or regulatory non-compliance, or consumer-protection claims, and is not responsible for investigating or resolving any third-party intellectual-property claims relating to the App. You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play terms
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. To the extent of any conflict between these Terms and the Google Play Terms regarding your acquisition or use of the App through Google Play, the Google Play Terms govern that conflict, but only to that extent.
Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date above and post the new version at this page, and material changes will be highlighted in the App or on our website. Your continued use of the App after an update means you accept the revised Terms.
Miscellaneous
These Terms and our Privacy Policy are the entire agreement between you and us regarding the App. If any provision is found to be unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms, and we may assign them to an affiliate or successor.
